Hartmann, Terry Hartmann, Mid States Express 401(k) Plan and Mid-States Express Inc. Employee Benefit Plan Allegations: The U.S. Department of Labor filed a lawsuit on Jan. 8, 2010, in the U.S. District Court for the Northern District of Illinois to recover $75,416.72, in unremitted employee contributions and participant loan repayments and associated lost opportunity costs to the Mid-States Express, Inc. 401(k) Plan as well as employee contributions and unpaid health plan claims of the Mid-States Express Inc. Employee Benefit Plan, a health plan, totaling $3,983,980. Mid-States Express Inc. was located in Aurora, Ill. The company filed for Chapter 11 bankruptcy protection on March 27, 2009, which was converted to a Chapter 7 bankruptcy on May 6, 2009. Bruce Hartmann filed for Chapter 7 bankruptcy protection on Nov. 18, 2011. The department’s suit alleged that Bruce Hartmann, the company’s chief financial officer and a trustee of the 401(k) Plan violated the Employee Retirement Income Security Act by failing to remit the employee contributions and loan repayments to the 401(k) Plan. Moreover, the department alleged that Bruce Hartmann also failed to forward employee contributions and fund claims of the health plan. Terry Hartmann, former chairman of the board and a trustee of the 401(k) Plan violated ERISA by failing to ensure employee contributions and loan repayments were remitted to the401(k) Plan’s trust account.

Four more trucking companies, including Chicago-area less-than-truckload carrier Mid-States Express Inc., have filed for Chapter 11 bankruptcy protection, becoming the latest casualties of the continuing economic downturn and credit crunch. Fifty-two-year-old Mid-States, which operated in 13 Midwest states until a service cutback in mid-March, had 521 workers and revenue of approximately $70 million last year, said Steve Hartmann, vice president of sales and marketing. In addition, Price Trucking Inc. of Aberdeen, Md., and F.T. Silfies Inc. of Allentown, Pa., which haul cement and limestone, made a March 25 Chapter 11 filing, stating they will continue operations during reorganization. In Texas, Gulf Coast Transport Inc., primarily a truckload operator, made its filing on March 31. The failures are the latest in a wave of bankruptcies among carriers, which topped 3,000 last year and led to a reduction of about 7% in trucking capacity. Other recent bankruptcies in-clude truckload operator Summitt Logistics & Brokerage of Clarksville, Ind., whose sales were listed at nearly $90 million. “Mid-States was like all carriers in our current economic conditions,” said Hartmann, whose company is based in the Chicago suburb of Aurora, Ill., and hauled general commodities, including retail and industrial goods. “It was in somewhat of a challenged financial situation. However, it was being worked through.” “We were a viable business,” Hartmann said. “We were working with a plan with our lending institution, and our lending institution simply quit funding. We couldn’t resolve things; we just ran out of funding.”

Baraboo resident Matt Bowen said he heard Thursday from other employees that the company would be closing its operation on Highway 12 just south of Moon Road. This left 750 people unemployed. They were a good- sized LTL van carrier that ran mostly in the upper midwest (OH, IN, IL, MO, WI, IA, MN). Heights Services, out of St. Paul, MN also closed its doors this week. This was a smaller van carrier, maybe 50 people at the most. I have friends that worked there. They did things the right way, protected their rates, treated their drivers well and serviced their customers. The owners just decided that there was no money to be made and pulled the plug before things got too ugly. Capacity seem to be consolidating more rapidly now. Does anyone else have any closures to report? I don't wish job loss on anyone, just trying to stay up to date. Mid States Express has closed their doors in Hammond, WI as the rumor is they can no longer get insurance to operate. A month ago I recieved a letter in the mail from a law firm in Chicago wanting to include me in a class action suit against this company for NOT paying the medical bills on time and the proper amount or percentages. I recall this happening when I was employed my them and it was always a problem with this company paying their bills. SAD..... So they have shut the doors... GOOD .... another company that liked to make up the rules as they go to suit themselves. Reset policy without putting it in writing and communicating it to the employees. Not a good way of doing business. Not a good way to manage people. Seems to be consistant with a lot of trucking companies in the central Illinois area.
