An official website of the United States government. Home Newsroom News Releases Wage and Hour Division FEDERAL COURT ORDERS LONG ISLAND CONTRACTORS TO PAY NEARLY $1M IN BACK WAGES, DAMAGES FOLLOWING US DEPARTMENT OF LABOR INVESTIGATION Defendants must also pay $53K in penalties for willfully depriving workers of overtime wages NEW YORK – Three Bellport concrete supply and construction companies and their owner, who schemed for three years to deny overtime pay to 99 laborers, have been ordered to pay the workers a total of $987,591 in back wages and liquidated damages, plus interest, in a consent judgment entered in the U.S. District Court for the Eastern District of New York. The court’s action follows a U.S. Department of Labor investigation into the pay practices of Macedo Construction Inc., Macedo Contracting Services Inc., Odecam Concrete Supply Corp. and Manuel Macedo. The companies and their owner must also pay $53,249 in civil money penalties and interest to the department for their willful violations of the Fair Labor Standards Act. The department’s Wage and Hour Division found that Manuel Macedo and his companies failed to combine the hours laborers worked at the commonly owned businesses. The employer paid them with multiple checks from the three companies to evade overtime requirements. Each separate check showed the employees worked less than 40 hours per workweek when they actually worked a combined total of up to 48 hours per week. In addition, they did not pay the employees for time spent traveling from the companies’ work yards to jobsites, and failed to make, keep and retain accurate records of the employees’ work hours and pay rates.

Feb 11, 2022 ... ... Macedo Construction Inc., Macedo Contracting Services Inc., Odecam Concrete Supply Corp. and Manuel Macedo. to pay 99 workers a total of ... Concrete contractor backpay order approaches $1 million POSTED BY NATIONAL ALLIANCE FOR FAIR CONTRACTING ON FEBRUARY 11, 2022 A judgment in the U.S. District Court for the Eastern District of New York orders Macedo Construction Inc., Macedo Contracting Services Inc., Odecam Concrete Supply Corp. and Manuel Macedo. to pay 99 workers a total of $987,591 in back wages and liquidated damages, plus $53,249 in civil penalties to the Department of Labor (DOL). The action settles charges of willful Fair Labor Standards Act (FSLA) violations identified in a DOL Wage and Hour Division investigation. It found Manuel Macedo and his Bellport, N.Y. companies failed to combine the hours laborers worked at the three commonly owned businesses, and paid them with multiple checks to evade overtime requirements. Each separate check showed the employees logged less than 40 hours per workweek when they actually worked a combined total of up to 48 hours per week. The companies also neglected to pay employees for time spent traveling from work yards to jobsites, and retain accurate records of the employees’ work hours and pay rates. “The scheme by Macedo Construction, Macedo Contracting Services, Odecam Concrete Supply Corp. and Manuel Macedo deprived their employees of nearly $491,000 in hard-earned wages over three years,” says WHD District Director David An. “In addition to the back wages, the employer must pay these workers an equal amount in liquidated damages, plus interest. We encourage other employers to consider this investigation’s outcome, review their own pay practices and contact the Wage and Hour Division to avoid similar violations. The consequences of noncompliance with federal labor laws can be serious and expensive.”

The owner of three Bellport concrete supply and construction companies must pay a total of $987,591 in back wages and damages after a U.S. Department of Labor investigation found that the employer schemed to withhold 99 workers’ overtime pay, according to a consent judgement issued by the U.S. District Court for the Eastern District of New York. Manuel Macedo, owner of Macedo Construction Inc., Macedo Contracting Services Inc., and Odecam Concrete Supply Corp., must also pay $53,249 in civil penalties to the labor department for violating the Fair Labor Standards Act. “The scheme deprived their employees of nearly $491,000 in hard-earned wages over three years. He instead paid workers with multiple checks – one from each company – to evade paying for overtime hours. Each check showed the employees worked less than 40 hours per week when they actually worked up to 48 hours per week. The employer also failed to keep accurate records of work hours and pay rates and did not compensate employees for travel time to job sites.
