It also is a common practice for the lawyer to act as agent for the title insurer which is issuing a policy of title insurance protecting the interests of the lender or buyer or both. Typically, the lawyer receives a commission from the insurer based on the amount of the policy. May a lawyer who represents one or more parties at a real estate closing also act as agent for the title insurer that is insuring the interests of the lawyer's client? A lawyer who serves as attorney for one or more parties, including the buyer or lender, at a real estate closing normally may serve also as title insurance agent. However, an impermissible conflict is possible when the lawyer serves in both capacities, and, at the outset of the representation of the buyer, the lawyer must advise the client fully of (i) any potential adverse impact on the lawyer's professional judgment caused by the lawyer's duties to the insurer as its agent or the lawyer's own financial interest in receiving a commission, (ii) the availability of coverage from other insurers, and (iii) the opportunity to seek independent counsel. The lawyer should remain alert to circumstances in which the interests of the insurer or of the lawyer may interfere materially with the representation of the client, and, in those cases, comply with the requirements of Rule 1.7 (b).

An official website of the United States government Nine Defendants, Including Title Company Owners And Lawyers, Indicted In Two Separate Mortgage Fraud Schemes U.S. Attorney's Office, Northern District of Illinois CHICAGO — A couple who owned a now-defunct suburban title company, a disbarred attorney, and an attorney are among nine defendants who have been indicted in two separate mortgage fraud cases, federal law enforcement officials announced today. Seven defendants were charged together in one case, and two in the second case, together alleging schemes to fraudulently obtain at least four residential mortgage loans totaling more than $1 million from lenders. Both indictments allege that the mortgages were obtained to finance the purchase of properties on Chicago’s south side, using fraudulent means such as straw purchasers, short sales, inflated prices, and unqualified buyers, while the defendants allegedly profited. As a result, the lenders incurred losses because the mortgages were not fully recovered through subsequent sale or foreclosure. Seven defendants were charged in an indictment that was unsealed on Monday following the arrest of HARVEY WRIGHT, 46, of Chicago, a disbarred South Holland attorney, and PRECIOUS HOUSE, 47, of Chicago. Also indicted, but not arrested, were DAVID GUEL, 60, and his wife, MARY GLEASON, 48, both of Blue Island; MUNTAZER ALI SAIYED, also known as “Monty Saiyed,” 37, of Bartlett; SAGED ANSARI, 32, of Hanover Park; and AZEEM SYED, 30, of Bolingbrook. All seven were charged with two counts of wire fraud and House, Syed, Saiyed, and Ansari were also charged with one count each of identity theft. The indictment seeks forfeiture of more than $800,000.
